  1. I wrote this letter to Albertans a few days ago. Wouldn’t you guess: of the nine or so newspapers and outlets I contacted only one even bothered getting back to me, to say it was too long to print. This isn’t a tip or news, just a hurtin Albertan who dares interpret the law.

    The strange events of the past year have taken their toll on all of us. Many have suffered physically, many more have suffered financially, and many more again have suffered spiritually and emotionally. But while the physical suffering of Covid-19 is due to the coronavirus, a thing outside our control, the financial suffering of closed businesses and the emotional suffering of closed homes is due to the government’s response to coronavirus—a thing we should be able to control. Let this be clear: it is not the threat of any virus that keeps so many from their employment and pay, but the threat of government fines. It is not for fear of a pathogen that friends have gone without visiting each other for so long, but for fear of the government’s lockdown.

    We can argue till we keel over about whether the choices by the Government is effective. We can bring up this or that study about masks, this or that statistic about social distancing and we may or may not be right. Questions of effectiveness are scientific questions, and like any scientific question, they are open to debate. And though these questions are important and should be debated, there is a question still more important. A question that makes all the scientific ones moot: a question that absolutely everybody under lockdown should be thinking about, but almost no one is. The question is: is the lockdown legal?

    Many will say to this, “Of course it’s legal! The government’s doing it. The government makes the laws, so how can what it’s doing be illegal?” and at first that seems correct: the government does indeed make the law. But can the government make any law? Can it make a law that forces you to deny your religion, or a law that calls for you to be killed? No, it cannot. As Canadians, we have constitutional rights, and the constitution, messy as it may be, is the supreme law of Canada. We have the right to freedom of religion and the right to life, and for that reason the Government of Alberta cannot simply end our faiths or our lives. We also have the constitutional right to “freedom of peaceful assembly, and freedom of association.”1 and also “the right to life, liberty, and security of the person”.2 But in response to this, some people might point to Alberta’s Public Health Act, which says that the medical officer of health may “take whatever other steps are, in the medical officer of health’s opinion, necessary to lessen the public health emergency.”3 This is what Dr. Deena Hinshaw, Alberta’s Chief Medical Officer of Health, has done. The Public Health Act makes it clear that the CMOH can do anything she wants to if she thinks it will help the coronavirus situation.

    But look again at the constitution: “The Constitution of Canada is the supreme law of Canada, and any law that is inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect.”4 The Constitution is supreme. The Constitution that guarantees our right to assemble and associate is supreme. It’s very clear to see that when you take the Health Act saying that the CMOH can do whatever she chooses and put it together with Dr. Hinshaw choosing to ban assembly and association, what you get is a law that is inconsistent with this supreme law. What you get is a law that is of no force or effect. The lockdown law is simply not law, and we as Albertans should not treat it as if it were. The business owners who want to reopen their business should go ahead and open up; they’re not doing anything wrong. The friends who want to get together and have a skate should do exactly that; it’s against no laws. The law enforcement personnel who don’t want to enforce the lockdown law shouldn’t enforce it; it’s not actually the law. In fact, enforcing a law that violates our constitutional rights is itself a violation of our rights: a crime. Can anyone that understands this support or enforce the lockdown in good conscience?

    It’s fair to wonder why, if the constitution makes the lockdown invalid, the lockdown persists. What is this “supreme law” worth if the premier’s administration can contradict it and continue to contradict it without any repercussions? Unfortunately, the Constitution alone is not enough to protect us. By itself, it’s just a piece of paper with too much ink on it. Only if we uphold the Constitution by our own actions does it have meaning. Only if we give it supremacy does it reign supreme. We must stand up for our freedom, and stand up with the confidence that we are on the side of what is right and lawful, if we are to enjoy that freedom again. I humbly ask all of my fellow Albertans to live freely and without fear, for just as the constitution only has power to free us if we choose to give it that power, the lockdown only has power to oppress us if we choose to let it. If we all choose to live freely today, the lockdown will end today.

    What I have said here is not, or rather shouldn’t be, controversial in the slightest. I am not calling for revolution or crimes of any kind to be permitted. I am not advocating for anything reckless. I am not advising anyone to do anything to put their health or anyone else’s at risk. Rather, all I have called for is for the law to be recognised and upheld: the real law of our land. But I am not naïve—I know that all or most newspapers and mainstream media outlets will refuse to print or publish this letter. I therefore also ask that anyone who sees this letter will copy it for themselves and share it with other Albertans.

  4. Re: Today’s Video:
    The amusement park featured in today’s video link, Belmont Park, in Montreal, was partially owned by Justin Trudeau grandfather, Charles (1887-1935), who was a mover and shaker back in the day. He had a stake in other things like mining, oil and gas, the Montreal Royals Baseball farm team, etc. See mini-bio below. Interestingly, Charles Trudeau was a Conservative, unlike his son and grandson.

    Note in the video from the Gazette, back in 1960, all the signs in Belmont Park were posted in the English language, it was the international language of business. As a native of that city, I remember walking into any place of business and there were no hassles getting service in English. Everyone spoke English. I wouldn’t try that today, incidentally, “Bonjour-Hi” as a greeting is now forbidden!

    1. To my surprise, I have a couple heavy turquoise cigar ashtrays that his company made in 1920’s. It has a smal gold sticker with the Trudeau company on the bottoms. Nothing special, just a rounded hunk of turquoise rock with the center rounded and to groves for cigars.
      I don’t think it’s worth much but is interesting what they thought was quality with semi precious stone. Would have been far nicer had they carved something special on it.

    3. My father spent time in Montreal in WW2. One of his jobs was guarding a German pilot at the Montreal Neurological Institute. He always said it was an English city. He hadn’t heard anyone speak French in Montreal.

    1. After reading that article, I’m glad I never got a university faculty position. Who, in their right mind, would want to put up with all that nonsense?

      One of the commenters said that academics are sociopaths who are hungry for power, non-conforming misfits, or cowards. I think the latter can be divided into genuine cowards, those afraid to say anything lest their chances at tenure be jeopardized, and those who don’t want to leave because they’d have to give up their seats at academe’s golden hog trough.

      I noticed much of the same mentality nearly 30 years ago when Armpit College changed its way of doing things. On that day, we no longer had students but “customers”. Instead of fanatical adherents to “woke” ideology, we had equally zealous followers of the “student as customer” and “learning quality” doctrines.

      They used their zeal to solidify their jobs by attending all sorts of indoctrination sessions (euphemistically called “training”), letting it permeate their existences and behaviours to the point that they even spoke in those terms using the same buzzwords. Many of them recognized the value of that and used their status as a means of worming their way into positions of authority.

      Of course, there were dissenters, including me. Most of them were tolerated by the institution as they were regarded as mostly harmless. However, since my department head was the one who was responsible for inflicting that bullcrap onto the institution (as a way of hoping that he’d be promoted to dean or even higher), he made a great effort to make my life miserable. My open defiance was a black mark on his claim that our department was fully indoctrinated and dedicated to the holy cause.

      Many of my department colleagues didn’t think much of all that, but they, being the chickensh*ts they were, went along with it. However, most were silent about my department head’s persecution of me. He was doing to me what they themselves would have liked to have done because I wasn’t “one of them” (too educated and too independent for their liking).

      I’m sure the current “woke” baloney is applied the same way for the similar purposes. It provides a convenient excuse to exact revenge on one’s enemies with adherence to the prevailing doctrine being the justification.

      All I can say is that I’m glad I’m no longer in that business. I’m worth far more now than I would have been had I stayed at AC for much longer.

    True, it is hard to sympathize with rich parents who are able to fork over $50,000 for a kiddie to go to school, as if they have problems. But then again, the PC behemoth culture picks off dissidents one by one, since dissidents with conservative instincts are slow to organize themselves effectively. Here, if I was a rich family with a 14-year-old kid, I would bundle him off to a good, Bible-oriented Christian school for a solid, no-nonsense STEM education. And why pay $50,000 to a leftist school? Then pick a good, high-quality university with little woke culture, and have the student major in a STEM field.
