The Supreme Court on Friday rejected the Biden administration’s request to be allowed to temporarily enforce most of an April 2024 rule implementing Title IX of the Education Amendments of 1972, which prohibits sex discrimination in education programs that receive federal funding, while its appeals continued.

Friday’s ruling leaves in place for now decisions by federal appeals courts that barred the Biden administration from enforcing any portion of the rule, including three provisions that target discrimination against transgender people in schools. The Biden administration had not asked the Supreme Court to intervene with regard to two of those provisions. […]

The orders came in two separate challenges – one filed in Kentucky by six states and one in Louisiana by four states. Both challenges focused on three provisions of the April 2024 rule that target discrimination against transgender people. The first provision recognizes that Title IX’s ban on sex discrimination includes discrimination based on gender identity. A second provision at issue in the case makes clear that schools violate Title IX when they bar transgender people from using bathrooms and locker rooms consistent with their gender identity. And a third provision defines “hostile-environment harassment” to include harassment based on gender identity, which the states say could require students and teachers to refer to transgender students by the pronouns that correspond to their gender identity.

  1. Suffering discrimination.. Laws that demand equal time for fringe groups have nothing to do with equality..

  2. I’d be happier if the SCOTUS had just said “You know what? There’s no Constitutional authority for all of Title IX in the first place. It’s all voided, and get the hell out of education.”

    1. Unfortunately the SCOTUS would fall back on the Commerce Clause of the Constitution which allows the Court to administrate Interstate Commerce … hence they can make all the revenue generating men’s college athletics S-H-A-R-E their $$$ with the girls … same with ALL education budgets.

      The upside is we get fewer FAT girls because they’re out running around and whatnot. Well, except for Softball … where there are some real heifers. There. Was I offensive enough?

The grandbrats are all still relatively young, though eldest has reached “thirteen and perfect” (progressing to “sixteen and infallible, seventeen and insufferable, and eighteen and almost human we hope”), and the rest aren’t far behind which will make for some interesting years. Family sports are tennis and hockey. Note tennis is strictly segregated by sex, while hockey at this level is still mixed though we’ve noticed fewer girls than boys in this particular league. Pre about age 13, the girls and boys seem to be fairly evenly matched, particularly as the girls tend to get their first growth spurt about age 11 – 12. After that, we’ll see how it works out.
    As an aside, youngest grandbrat is not hesitant about engaging with boys on the opposite team when fighting for the puck. We rather think she has honed her skills skirmishing with her brother.
